Proposed Turn over Document

Residents,

Greetings to all residents of East Georgetown Shores Lake Association.  The first lots in our development were sold in the 1999 time frame and over several years and 6 phases of construction Georgetown Shores has  become a great place to live and build community.

Over the years the advisory committee has worked on behalf of the residents to help the developer in the daily operations and issues of the association.  We have been in discussions with the developer on a time frame for the turning over of the association to the residents.  Over the last few months the advisory committee has been working with the developer to protect their continued interest but at the same time give the residents control of the association.

Here is the Proposed Turn Over Document that has been presented to the residents for their vote of approval.  We will discuss this at the meeting at 9:00 am on April 14th and vote whether or not to accept the association under these terms.

Please review the document and be prepared to vote whether or not to have the advisory committee sign this document on all of the residents’ behalf.  If we vote to approve the document, we will work out the plan to transition from the appointed advisory committee to an elected association board.

    1. I wish to print this document but am not able. Is this not allowed? Or is there another reason.
    2.The association does not have a board in place to take over.When will nominations take place for our board?

    Pete, I do not know why you cannot print the document. It should be open for printing and no issues.

    As for the association, today the association is controlled by the developer. The developer has put in place an appointed “Advisory Committee” that has been in place for a number of years. The Committee suggested to the developer additional names to increase the committee in order to get better coverage of the phases last year.

    We now have 8 members on this committee. If, the proposed turn over document is approved, we recommend that this committee serve for one more year as it is in order to provide stability as past knowledge. The proposed agreement states that there is also to be one member on the board from the developer and that would make 9.

    The following year we can vote to replace or reinstate 4 of those members for a term.

    What types of costs will the association absorb in this transfer? Will our dues increase?

    I also find it interesting that the developer retains the right to “reverse, rescind or invalidate any of the
    following (within 60 days of the date that the Association delivers to BG a written notice of the enactment or adoption of any of the following at 10600 Linden Drive, N.W., Grand Rapids, Michigan 49534 or such other address as BG designates to the Association in writing):
    (i) Any decision or action by the Association or the Association’s
    Board of Directors.
    (ii) Any decision or action by the membership of the Association.
    (iii) Any amendment to the Bylaws or Articles of Incorporation for the
    Association.
    (iv) The adoption or amendment of any rule or regulation of the
    Association.
    (v) Any similar decision or action.”

    Sounds as if they still want control yet without the responsability of the costs.
